Terms of Use
Last updated: October 11, 2026
These Terms of Use (“Terms”) govern your access to and use of the websites, products, applications, and services (together, the “Services”) provided by Daynomic LLC (“Daynomic,” “we,” “us,” or “our”). By accessing or using the Services, or by agreeing to receive text messages from us, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and authority
You must be at least 18 years old, or the age of majority where you live, to use the Services, unless a specific product states otherwise. If you use the Services on behalf of a business or organization, you represent that you have authority to bind it to these Terms, and “you” includes that organization.
2. The Services
Daynomic builds software products for individuals, businesses, and organizations. We may add, change, suspend, or discontinue any part of the Services at any time. Some products may have additional terms, which apply together with these Terms. If they conflict, the product-specific terms control for that product.
If you are a business customer with a written agreement with us, such as a master services agreement or data processing agreement, that agreement controls where it conflicts with these Terms.
3. Accounts
Some Services require an account. You agree to provide accurate and current information, keep your credentials confidential, and notify us promptly of any unauthorized use. You are responsible for activity under your account. You can delete your data and deactivate your account from within the product, or by emailing privacy@daynomic.com.
4. Acceptable use
You agree not to:
- Use the Services in violation of any law or regulation
- Infringe or misappropriate the rights of others
- Upload or transmit malware, or interfere with or disrupt the Services or their security
- Access the Services by automated means, such as bots or scrapers, except as we expressly allow
- Probe, scan, or test the vulnerability of the Services without our written permission
- Reverse engineer, decompile, or attempt to extract the source code of the Services, except as the law allows
- Use the Services to send spam, harass others, or submit false, misleading, or unlawful content
- Resell or provide the Services to third parties except as we expressly permit
- Use the output of the Services to build a competing product or to train AI models, except as we expressly permit
We may investigate violations and may suspend or terminate access if we believe you have breached these Terms.
5. Your content
You keep ownership of the content you submit to the Services (“Your Content”). You grant Daynomic a limited, non-exclusive, worldwide license to host, process, transmit, and display Your Content solely to operate, secure, support, and provide the Services to you. You are responsible for Your Content and for having the rights needed to submit it.
We handle Your Content as described in our Privacy Policy. We do not use Your Content to train AI models.
6. AI features
Some Services use artificial intelligence, including models provided by third parties, to answer questions about the information in the product you are using. They are not general-purpose assistants. AI-generated output may be inaccurate, incomplete, or inappropriate, and similar inputs can produce different outputs. You are responsible for reviewing output before you rely on it. Do not rely on AI output as legal, medical, financial, or other professional advice, and do not use it for decisions that could significantly affect a person’s rights or safety without human review.
7. Intellectual property
The Services, including their software, design, text, graphics, logos, and the Daynomic name and marks, are owned by Daynomic or its licensors and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms, we grant you no rights in them. You may not use our name or marks without our written permission.
If you send us feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without obligation to you.
8. Fees and payment
Some Services are paid. Fees, billing cycles, and any free trials are described when you purchase. Payments are processed by our third-party payment processor, and you authorize us and our processor to charge your chosen payment method. Unless we say otherwise at purchase, subscriptions renew automatically until you cancel, fees are non-refundable except where the law requires, and you are responsible for applicable taxes. We may change prices with advance notice before your next billing period.
9. Text message (SMS) program terms
These terms apply if you agree to receive text messages from Daynomic.
Program: Daynomic text messaging. By checking the SMS consent box on a form, or by otherwise giving us your express consent through our website, an application, or another opt-in method, you agree to receive text messages from Daynomic at the mobile number you provided. These may include responses to your inquiry, follow-up and customer care messages, appointment and scheduling messages, account and service notifications, and security or authentication messages. If we send marketing or promotional texts, we will do so only with your separate, express consent.
Consent is not a condition of purchase. Providing a telephone number is not consent to receive texts. Message frequency varies, and recurring messages may be sent where applicable. Message and data rates may apply. Text messages may be sent using automated technology.
To opt out, reply STOP at any time; you will receive one confirmation message and no further texts. For help, reply HELP or contact us at privacy@daynomic.com. If you opt out and later want to receive messages again, you can reply START or give us consent again.
Participating wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device. We do not sell or share mobile phone numbers or text messaging consent information with third parties or affiliates for their own marketing or promotional purposes. See our Privacy Policy for how we handle your information.
10. Third-party services and links
The Services may include links to, or integrations with, third-party websites and services, such as payment, analytics, bot-protection, and AI providers. We do not control them and are not responsible for their content or practices. Your use of them is subject to their terms and policies.
11. Disclaimer of warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any output will be accurate. See also our Disclaimer.
12. Limitation of liability
To the fullest extent permitted by law, Daynomic and its members, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the Services or these Terms, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims relating to the Services or these Terms will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim arose or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Daynomic and its members, officers, employees, and agents from claims, damages, liabilities, and expenses, including reasonable attorneys’ fees, arising from Your Content, your use of the Services in breach of these Terms, or your violation of any law or third-party right.
14. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms, if required by law, or to protect the Services or others. Sections that by their nature should survive termination, including content licenses needed to complete obligations, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive.
15. Governing law and disputes
These Terms are governed by the laws of the State of Georgia and applicable United States federal law, without regard to conflict-of-law rules. You and Daynomic agree that any dispute arising from these Terms or the Services will be brought in the state or federal courts located in the State of Georgia, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information. Before filing a claim, you agree to contact us at privacy@daynomic.com and try in good faith to resolve the dispute informally for at least 30 days.
16. Copyright complaints
If you believe content on the Services infringes your copyright, send a notice to privacy@daynomic.com that identifies the work and the allegedly infringing material, includes your contact information and a statement that you have a good-faith belief the use is unauthorized, and states under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner. We may remove content and terminate repeat infringers.
17. Export and sanctions
You agree to comply with applicable export control and sanctions laws and not to use the Services if you are prohibited from doing so under those laws.
18. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, where required by law or for material changes, give you notice through the Services or by email. Your continued use of the Services after the updated Terms take effect means you accept them.
19. General
These Terms, together with our Privacy Policy and any product-specific terms, are the entire agreement between you and Daynomic about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, but we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for failures caused by events beyond our reasonable control.
20. Contact us
